On Tuesday, January 9th, 2018 the Union and had an arbitration with the hospital over contingent pay raises. At issue is the --- raise. Contingents were not given their raise. Management argued that the contingents were not included in the raise! The Union proved that the Contingents WERE entitled to the raise, and they received their raise. However, management shorted the contingents by two weeks, arguing that the Contingents weren’t entitled to the full back pay!
The Union has argued that the Contingents ARE entitled to the full pay raise and filed for arbitration.
Management admits the amount in question is only about $3,700.00, but they refuse to pay it, preferring instead to pursue a costly arbitration. An arbitration normally costs a minimum of $1,000.00 and up to $1,500.00 per day of hearings and the arbitrator’s time to write the decision, which is a minimum of $2,000, and often more. The minimum cost to management for arbitration is generally around $7,000.00 because they have to pay for their attorney’s time, research time and travel.
In short, management was willing to spend $7,000 on an arbitration that would have only cost $3,700.00 to avoid. How does this make sense? Nurses have to be fiscally responsible with hospital resources, but apparently management does not!
The only offer management made to settle the arbitration was to pay the contingents significantly less than what they were owed. The Union refused this offer. Jeff Morawski, Local 40 President was clear about the Union’s reasons:
“This is a clear message from the hospital about how they value their RNs. It is the ultimate sign of disrespect, and a slap in the face to the members of Local 40 and is a true sign of their level of commitment to patient care.”
All nurses are worth 100% of their wages. Nobody is worth partial payment. The hospital agreed to pay the wages, agreed they owed the wages, but wants to short the contingents.
We need our contingents! They help us cover vacations, cover when we are out on LOA, and many work extra hours to fill the holes caused by management’s short staffing. We stand united for safe staffing and respect for ALL RNs.

Bargaining Report: Progress Made to Conclude Non-Economics
Our last bargaining session was productive. We have had good dialogue with management and believe we will be able to settle the non-economics in our next session. We have made significant progress with language to enhance our protections under the contract. Management asked for time to research the last remaining item to settle. If they can complete that work and come to an agreement on the remaining issue, we will be able to resolve the non-economics next week.
